If a foreign national who had entered India on a visa has over stayed it, then he cannot leave India without obtaining an exit permit from the Foreigners Regional Registration Office (FRRO) of the concerned jurisdiction before he is permitted to travel.

 An exit permit is a mandatory document that permits a foreign national to leave India after payment of the appropriate fines/penalties depending on the duration of overstay. What Is an Exit Permit and Who Needs One?

An exit permit is a clearance permit provided to a foreign national to exit India which is issued by the FRRO, or by a local Foreigners Registration Office (FRO) when their visa has expired and has been overstayed. An exit visa India does not extend one’s stay, rather it only makes the exit legal and regularizes it through payment of fines and penalty.

An exit permit is to be applied for in the following circumstances-

 If the visa has expired and the individual has overstayed it

What Counts as a Visa Overstay in India?

If a foreign national stays even a single day beyond the duration for which his visa has been issued, that duration counts as an “overstay” making the extended stay as illegal.  In case of any medical exigency with the foreign national or with his friends or family in India, preventing timely exit.

 If the flight has been missed, cancelled or rescheduled

What Is the Penalty for Visa Overstay in India?

Section 23- Penalty for contraventions of the provisions of the Act-

Whoever -

(a) being a foreigner, remains in any area in India for a period exceeding the period for which the visa was issued to him or stays in India without a valid passport or other valid travel document in contravention of provisions of section 3 or does any act in violation of the conditions of the valid visa issued to him for his entry or stay in India or any part thereunder;

(b) contravenes any other provisions of this Act, other than sections 17 and 19, or of any rule or order made thereunder or any direction or instruction given in pursuance of this Act or such order or direction or instruction for which, no specific punishment is provided under this Act, shall be punishable with an imprisonment for a term which may extend to three years or with a fine which may extend to three lakh rupees or with both.

The FRRO generally applies a compounding financial penalty commonly referred to as an overstay compounding fee India which is dependant on the duration of  the overstay.       Copy of the visa on which the foreign national had entered in India.

      An undertaking and written explanation stating the ground of overstay.

      Proof of accommodation in India during the overstay.

      Police clearance certificate, if requested by the FRRO officer handling the case.

3. Upload Supporting Documents- Once the application has been filled, the clear scanned copies of the documents must be uploaded.

4. Pay the Applicable Penalty- Once the application has been submitted and the documents are uploaded, the FRRO reviews the same and generates the amount of penalty to be paid based on the duration of overstay.

5. Attend Verification (If Required)- In some cases where the overstay is for a longer duration or the reasons are not satisfactory to the FRRO, they require an in-person appearance of the applicant at the FRRO office for document verification or an interview.

A visa extension is applied when an applicant wants to extend his stay in India before the expiry of their visa, which is subject to the approval of the FRRO. An exit permit on the other hand, is applied for after the visa has already expired, and the visa extension (if applied for) has been denied or rejected.
